豪州議会、条件を満たすまで模造品・海賊版拡散防止条例(ACTA)批准の延期を助言

知的財産権にかかわる模造品・海賊版拡散防止条例(ACTA)について、オ-ストラリア議会の条約委員会が「ACTA批准を待つべき」という助言を提出しました。豪のTPP交渉スタンスに一定の影響を与えうる内容と判断し、翻訳グループが訳しました。(翻訳:戸田光子 監修:廣内かおり)

Australian Parliamentary Treaties Committee recommends deferral of ACTA until conditions met


これは、TPPの著作権関連事項がACTAあるいはACTA-Plusを基にしているため、それ自身よいニュースであり、TPPにも影響を与えうるものである。この委員会が通商協定を見直すのは内閣が署名した後に限られる。したがって、 委員会で内閣の決定を覆すことはできないが、ある程度の政治的な圧力になる。
This is good news in itself and could impact on the TPP, since some of the copyright stuff is based on ACTA or ACTA-Plus.
This committee only reviews trade agreements after Cabinet has signed them.The committee cannot overturn Cabinet decisions but has some political embarrassment power.

オーストラリア・デジタル・アライアンス(図書館、大学、博物館の団体)、 IP(知的財産権保護)団体、そしてさまざまな学術団体は批判的な意見表明をしており、その影響もでている。委員会がこうした批判的な助言をした最近の過去2回の例は、2004年豪米FTAと 1998年のMAI(多国間投資協定)であるが、2004年のFTAの協定に対しては委員会の意見が分かれ、1998年のMAIの協定には反対するよう助言している。欧州議会の国際貿易委員会が先週ACTAを棄却することを投票で決定したことに言及している点に注意のこと。
The Australian Digital Alliance, IP groups and various academics made critical submissions which have had an impact.
The last two times the committee made such critical recommendations were the Australia-US FTA in 2004, on which it was split, and the MAI in 1998, which recommended against that agreement.
Note the reference to the fact that The European Parliament’s International Trade Committee last week voted to reject ACTA.

条約委員会、ACTA批准の延期を助言
Treaties Committee recommends deferral of ACTA

条約委員会は、議論になっている模造品・海賊版拡散防止条約(ACTA)を、 そのコストと利益について、独立した透明性のある経済分析を含む一定の条件を満たすまで、批准しないよう助言した。ACTAは知的財産権基準を世界的規模で強化するために考案された協定である。これは商標ならびに著作権保護に焦点を合わせ、知的財産権保護の実施の法的枠組みを確立するものである。
The Treaties Committee has recommended the controversial Anti-Counterfeiting Trade Agreement (ACTA) not be ratified until certain conditions, including an independent and transparent economic analysis of its costs and benefits, are met.ACTA is an agreement designed to strengthen intellectual property standards around the world. It focuses on trademark and copyright enforcement and establishes a legal framework for IP enforcement.

しかし、委員会の委員長、ケルヴィン・トムソン議員は、この協定には不備な点が多くみられ、委員会はこれがオーストラリアの利益になるという確信がまだ 持てないと言う。トムソン氏によると、委員会は、現在のオーストラリア法改革委員会の著作権およびデジタル経済に対する調査に加え、ACTAに関してさらなる分析と解明が行われることを要求したとのことである。
However Committee chair Kelvin Thomson MP says the agreement exhibits a number of flaws and the Committee is not yet convinced that it is in Australia’s interests.
Mr Thomson says the Committee has asked for further analysis and clarification of ACTA to be undertaken, in addition to the existing Australian Law Reform Commission Inquiry into Copyright and the Digital Economy.

“The Committee is concerned about the lack of clarity in the text, the exclusion of provisions protecting the rights of individuals, and ACTA’s potential to shift the balance in the interpretation of copyright law, intellectual property law and patent law,” Mr Thomson said. “The international reaction to ACTA, which, without exception, comes from countries which the Committee considers would have the same interests as Australia, must also be taken into consideration.”

委員会は、9つの助言をした。その中には、以下の時点まで、オーストラリアは模造品・海賊版拡散防止条約(ACTA)を批准しないようにという助言がある。

The Committee has made nine recommendations, including that the Anti-Counterfeiting Trade Agreement not be ratified by Australia until the:
• Treaties Committee has received and considered an independent and transparent assessment of ACTA’s economic and social benefits and costs;
• Australian Law Reform Commission has reported on its Inquiry into Copyright and the Digital Economy; and the
• Australian Government has issued notices of clarification in relation to the terms of the
Agreement.
The Committee also recommended that, given their importance in the world economy, Australia should also have regard to ACTA’s ratification status in the European Union and the United States of America. The European Parliament’s International Trade Committee last week voted to reject ACTA.
